AUSTRALIA BANS PROSPECTIVE INTENDED PARENTS FROM COMMISSIONING SURROGACY OVERSEAS: LATEST UPDATE ON INDIA- AUSTRALIA SURROGACY
The Australian government has published updates on the medical visa policy for commissioning surrogacy in India.Surrogacy Laws India, New Delhi had published earlier that Australian Intended Parents have been halted temporarily from being granted Medical visa to fly to India.The current update is as follows:
1.India will no longer issue medical visas to Australians planning to commission surrogacy who reside in Australian states/territories where overseas commercial surrogacy is illegal (currently the Australian Capital Territory, New South Wales and Queensland)

“Visa guidelines for commissioning surrogacy
It is an Indian Government requirement that Australians undertaking travel to India for the purpose of surrogacy obtain an Indian medical visa.In late *** India changed its policy in relation to this visa.India will no longer issue medical visas to Australians planning to commission surrogacy who reside in Australian states/territories where overseas commercial surrogacy is illegal (currently the Australian Capital Territory, New South Wales and Queensland).In practice, this means that residents in these states/territories will not be permitted to enter into surrogacy arrangements in India.
It is possible that India will make further changes to its surrogacy policy in *** which could affect residents in other Australian states/territories.
We recommend that Australians contemplating surrogacy contact the appropriate Indian mission in Australia for advice and familiarise themselves with India’s surrogacy laws and related visa regulations well in advance of any planned travel.You should also seek independent legal advice.
