THAILAND started emerging as the new surrogacy capital of the world when Indian proposed a temporary ban on single parents & heterosexual couples not married for two years.Within month’s couples all across the globe found Thailand a comfortable alternative to India.This primarily has the reason of Thailand having no law about surrogacy, country being acceptable to sex selection and almost a similar surrogacy package cost.However what awakened the innocent Intended Parents who were opting for Thailand was the prohibition the country imposed on Israeli citizens from taking children born to Thailand surrogates back to their home country.
As per Thailand Law the child born to a Thailand surrogate was still a child of Thailand despite the genetic material of a parent of different country.
Thailand again came into News when the speedily growing surrogacy destination, had a case of down syndrome child being left by Australian Couple, taking the healthy twin back to Australia.News is also there that a Japanese father had 15 babies delivered via surrogate in Thailand.
Thailand responded to this awakening call and went ahead with the same speed, to forever ban surrogacy in the country (Commercial surrogacy was never allowed only by Thailand Medical Council).A draft bill, which will see those caught profiting from surrogacy punished with up to 10 years in prison, passed its first reading and received an overwhelming response from legislators.
To quote lawmaker Wallop Tungkananurak
“We want to put an end to this idea in foreigners’ minds that Thailand is a baby factory,”
The bill, which will return to the Thai parliament in mid-January for a second and third reading, does not outlaw surrogacies within families and shall forever ban surrogacy for foreigners.
With Indian Government temporarily banning and Thailand permanently NEPAL has started gaining favoritism again.Though many doctors and clinics have shifted their base from India to Nepal the legal situation in Nepal also is somewhat similar.

It doesn’t take a genius mind to decipher that Nepalese women cant substitute for the quantity of surrogacy business that India used to handle.Many may argue that India has only banned singles or homosexuals (Homosexuals were never permitted only in India) to this the stats available say that more than 50% or even higher percentages of commissioning couples visiting India were singles.
Thus the alternative left to this problem is to send improperly and illegally Indian women to Nepal and treat them medically there till they deliver the child.
On the regulation aspect as well Nepal doesn’t stand on a situation better than Thailand.Nepal has no regulation governing surrogacy except a judgment reported in *** by Judge Tek Narayan Kunwar which was a dispute over a child born through surrogacy to Nepalese Commissioning couple itself .He ruled that a surrogate child should have the same rights as a biological one, and should be entitled to inheritance rights.
Surrogacy Procedure is not defined by Nepal law, but there are laws restricting use of citizens of the state for the benefit of the procedure.In contrast, the local law allows registration of foreign citizens who give birth in the country
Social activist and women group in Nepal fear that Nepalese women would be used and exploited in the surrogacy procedure as the country still has unregulated surrogacy field.
To quote Human rights activist and advocate from Nepal,
“The government should not wait for the problem to grow but should be prepared to deal with it before things go out of hand.”
“Poverty is the basic reason behind thriving business of commercial surrogacy in India.We know the status of poor women in Nepal.If we expect to act only after the problem grows, many women are going to be exploited badly,” she said.
