Hello Kris, We truly hope over our communication since this post you found the answer in the billing that it was a deposit then credited to your surrogate as requested and that resolves that concern. In our quest to answer any questions, that any other errors were clarified in our communication and support as we reached out to you and your lawyers as we only wanted your success. We know this is an emotional journey when it goes perfectly and when there is confusion around contracts and money it becomes stressful. Contracts are to be fulfilled and I believe your lawyers did give you that best advice as you are now home enjoying your precious children. We wish you all the best that is now settled fully as time has passed and your children are thriving as we did not see this post until now sadly. Did not follow contract and custody battle lasted longer than pregnancy
Working with ANU Fertility, and the owner/operator Lorraine Brown, has been one of the most stressful and frustrating experiences of our lives.Lorraine added charges and double billed us, while calling us names and trying to scare and embarrass us because we were following the contract that was written to protect both the surrogate and us.Finally, the legal custody battle after the pregnancy was over lasted longer than the pregnancy did! Lorraine advised that her role was to act as an intermediary between the surrogate and the gestational parents.She was provided with a finalized copy of the surrogacy agreement that was written by the lawyers and agreed to by both the surrogate and ourselves.The contract was very specific.It listed allowable expenses (things like medications, gas to appointments, additional food related to pregnancy, babysitting, housekeeping, wage loss, etc) with maximums for these expenses.The final page had a summary of the maximum allowable reimbursed amounts, which totalled up all the possible expenses that were in the main part of the contract. The contract was finalized in June and the transfer happened in July, however in September Lorraine advised the surrogate "I also sent the extra *** a month that is pre arranged to cover any additional expenses such as vitamins, daycare, gas or anything else you need while pregnant.Please be sure to ask for this amount each month" (Sept 1 email).The listed expenses were already part of what we were reimbursing, however Lorraine decided that we should be reimbursing more than the contract said.Lorraine said she sent this extra *** per month because of a sample contract that she showed us before we agreed to work with ANU, even though it was not part of the contract we agreed to, so now we were paying for these expenses twice! Lorraine was also sending us monthly statements requesting reimbursement at the cap that we agreed to with the surrogate, plus billing us for each of the expenses.So for example, the statement would say 'June reimbursement $XX dollars' and then 'June expenses (gas, childcare, etc) $XX dollars'.So instead of just double billing us, now Lorraine was triple billing us for the same expenses! (Original reimbursement amount which was well over *** per month and was supposed to cover all expenses, plus *** per month, and then actual expense amount).We had kept in contact with the lawyer who wrote up the contract and ended up telling her about our concerns - she was so upset about this that she got involved directly with Lorraine / ANU to make sure they realized that this was highly illegal where we are (Canada). The birth happened very early in the fifth month of pregnancy, and within a week we paid out the final post-pregnancy amounts based on the contract (The maximum post-pregnancy weeks of wage loss, childcare, and housekeeping, as well as the maximum reimbursable amount for the month that the birth happened, even though the birth happened in the first week of the month).The surrogate wanted to be paid the maximum amount for an additional 4 months of pregnancy, even though she was not pregnant any longer, AND to be paid the post-pregnancy amounts listed on the final-page summary, even though we had already paid this. And Lorraine agreed with this demand. Even though we already paid these expenses. Even though it is illegal in Canada. Again, a lawyer had to be involved because Lorraine was encouraging the surrogate by sending us very angry emails with name-calling and shaming, and copying the surrogate.The surrogate refused to give us custody during this whole process, and even threatened to never allow us to have custody unless we paid this money - this seems to fit the definition of extortion. Lorraine does not read or follow the contract that both parties sign, and does not represent anyone but herself and the surrogate.If you are considering working with a surrogacy agency, save yourself years of headache and heartache by choosing a different one than ANU.
